Appeal allowed from a decision that a child should not be in the day-to-day care of her birth parents. Original decision quashed and an order made that the child is to be in the day-to-day care of her birth parents (subject to conditions allowing her to see her whāngai parents).

Julian v Inia-McCaull - Estate of Moehuarahi Te Ruuri

Māori Land Court [2018] Chief Judge's MB 493 (2018 CJ 493)

3 September 2018

An application to cancel a succession order which vested all of the deceased's Māori land interests in the Inia Whānau Trust, preventing the applicant from succeeding to the land. The application was declined, nevertheless the Court amended the order constituting the Inia Whānau Trust by renaming the tīpuna as Moehuarahi Te Ruuri. This enabled the applicant and her children to be included as beneficiaries of the trust.

The Waitangi Tribunal has released a number of chapters from its report on its inquiry into claims in Te Rohe Pōtae (the King Country). The Tribunal has found that the Crown’s significant breaches of the Treaty of Waitangi caused serious damage to the mana and autonomy of the iwi and hapū of Te Rohe Pōtae.
