The Environment Court decided that compulsory acquisition of Māori freehold land (owned by Mrs Patricia Grace but recently gazetted as a Māori reservation) cannot be supported because the proposed taking is not fair, sound and reasonably necessary as required by s 24(7)(d) of the Public Works Act 1981.

Taniora - Te Koutu Mourea Māori Reservation

The applicants sought to have one acre excluded from Te Koutu Mourea Māori Reservation and to have it partitioned and vested in Erana Waiomio. While there was support for the exclusion, there was insufficient support for the partition. There was also a lack of evidence to demonstrate that the partition would facilitate better utilisation and development of the land.

This was the second reserved judgment of Judge Ambler concerning Hekenukumai (Hec) Busby's application for the setting aside of land for a Māori reservation for a whare wānanga for kaupapa waka. Judge Ambler was satisfied that the trust deed of the Hekenukumai Ngā Iwi Trust, the proposed beneficiary, aligned with the purposes of the reservation. Application granted.

Objections to an application to set aside land as a Māori reservation for a whare wānanga were dismissed. The rationale for the reservation was of "unquestionable merit" and would not affect the mana of Ngāti Tara. Application adjourned to allow for the applicant to provide more information about the proposed beneficiary, the Hekenukumai Trust.

The applicants were not tangata whenua and while the application was supported by some hapū, it was forcefully opposed by Ngāti Tama. The application may have succeeded if the beneficiaries were local iwi and hapū.

Trustees of the Ngatiwai ki Whangaruru Whenua Tōpū Trust opposed plans to develop a new marae complex. The marae committee, supported by beneficiaries, successfully applied for the termination of the Trust's trusteeship of the land and for the vesting of the land in the Ngatiwai Trust Board.
