The Court granted an ex-parte application for an interim injunction to prevent use of the Mahanga marae at Māhia without the permission of the trustees. A hearing was scheduled for late November 2012 for the Court to determine whether to extend or dismiss the injunction.

In April 2012 the Court issued an interim injunction restraining the trustees of Tataraakina C Trust from taking any further steps in relation to the appointment of an Executive Officer or Project Manager and Office Manager until further orders of the Court.
Following further hearings a number of consent orders were made and the interim injunction continued. These orders included the trustees resigning and being appointed advisory trustees to a newly appointed independent responsible trustee.

Kerr v Albert and others as trustees of the Ngahiamutu Land Trust – Maketu A102 (2012) 55 Waiariki MB 146 (55 WAR 146)

Mr Kerr was granted an interim injunction on 20 June 2012 to prevent the respondent trustees from evicting him from land. A further hearing on notice to the trustee landowners was scheduled to hear argument on whether to extend or dismiss the interim injunction while Mr Kerr’s substantive proceeding opposing eviction from occupation of the land remains undetermined.
