Decision on application for urgent hearing - The Ngāti Pāoa Trust Board Settlement Negotiations Claim

Application for urgent hearing declined. The applicants (members of the Ngāti Paoa Trust Board) had lost their mandate to negotiate a settlement on behalf of Ngāti Paoa, and applied for an urgent inquiry concerning the Crown's engagement with Ngāti Paoa lwi Trust. The Waitangi Tribunal rejected the application on the basis that there was no possibility that it would find that the Crown breached the Treaty in this matter.

Applicant sought directions regarding a debt to the applicant owed by the deceased's estate set down for further hearing to enable the trustees to be heard. Court suggested a transfer of related proceedings challenging the will of the deceased to the Māori Land Court once amendments to Te Ture Whenua Māori Act 1993 come into force on 6 February 2021.
